Renters Rights Act Implementation Confirmed

We've got some important updates to share about the Renters' Rights Act 2025. The government has published their timetable for reforming the private rented sector, and we wanted to highlight what this means for you.

 

For most landlords, this shouldn't be cause for alarm and it should be business as usual. The government has committed to giving time to prepare by rolling out changes in three phases.

Phase 1 – May 1st, 2026: Tenancy Reform

  • All new and existing tenancies will become periodic with no fixed end date
  • Section 21 will be abolished as a way to end tenancies
  • You'll use Section 8 to seek possession instead, including when you want to sell or move into the property
  • Tenants can give two months' notice to end their tenancy, aligned with their rent due date
  • You can increase rent to market level once every 12 months using a Section 13 notice
  • Accepting rent above your marketed figure won’t be allowed
  • No more than one month's rent in advance will be acceptable
  • Pet requests can't be unreasonably refused and must be handled within 28 days
  • You can't advertise properties excluding tenants with children or those receiving benefits (though you still choose your tenants)

 

Phase 2 – Late 2026: New Systems

Two new systems will be introduced during this phase:

  • Private Rented Database (likely rolled out locally)
  • Private Rented Sector Ombudsman (membership expected to be required by 2028)

 

Phase 3 – Timeline to be confirmed

These longer-term changes are still being finalised:

  • Decent Homes Standard implementation (expected 2035 or 2037)
  • Awaab's Law consultation launching soon (focusing on damp and mould responsibilities)
  • Minimum EPC rating of C required by 2030 (unless you have a valid exemption)
